The Terms of Service (the “Terms” or “Agreement”) are a legally binding agreement between our company and its Affiliates (collectively, “Kunpo games”, “we” or “us” or “our”) and you (“You” or “Your”) with respect to your use of or access to Kunpo games’ mobile or web applications, games, websites, and/or any other services owned, operated and published by Kunpo games (collectively, the “Services”). Affiliates shall mean subsidiaries, parent companies, joint ventures and other organizations or entities under common ownership with our company.

BY INSTALLING, USING OR OTHERWISE ACCESSING ANY SERVICE, YOU AGREE TO AND ACCEPT THESE TERMS AND ACKNOWLEDGE THAT YOU READ, UNDERSTAND AND AGREE TO BE LEGALLY BOUND BY THE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE EXIT SUCH SERVICE IMMEDIATELY AND DO NOT INSTALL, USE OR OTHERWISE ACCESS THE SERVICES. USE OF THE SERVICES IS VOID WHERE PROHIBITED. In addition to this Agreement, the Kunpo games privacy policy (the “Privacy Policy”) applies to your use of or access to the Services, and you should review it prior to any use of or access to the Services. BY INSTALLING, USING OR OTHERWISE ACCESSING ANY SERVICE, YOU ALSO AFFIRM THAT YOU HAVE READ AND UNDERSTAND THE PRIVACY POLICY. Your use of or access to the Services is strictly subject to these Terms as may be updated from time to time.
Kunpo games reserves the right, at its sole discretion, to change, modify the Terms, its Privacy Policy and other relevant Kunpo games policies, at any time and from time to time by posting the amended terms, policies or rules on the Kunpo games Services. Kunpo games may use reasonable commercial efforts to provide notice of material changes to you. Your continued use of the Services following the posting of such changes constitutes your acceptance of the revised terms, policies or rules. If at any point you do not agree to any portion of the then-current version of our Terms, the Privacy Policy, or any other Kunpo games policies, or other codes of conduct relating to your use of or access to the Services, your only recourse is to discontinue your use of the Services. You agree that Kunpo games may change any part of the Service, including its content, at any time or discontinue the Service or any part thereof, for any reason, without notice to you and without liability.
Subject to your continuous compliance with the Terms, the Privacy Policy, or any other Kunpo games policies, or other codes of conduct, Kunpo games grants to you a non-exclusive, personal, worldwide, non-transferable, non-sub-licensable and revocable limited license to access and use the Services solely for your own non-commercial entertainment purposes by accessing the Services through a web browser or mobile device. You can’t access to the Services or our products without connecting to the internet and our servers. You explicitly agree that you will not use the Services for any other purpose other than as provided for by these Terms. You agree not to copy, modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract source code of the Services or to allow or assist anyone else to do so.
Kunpo games expressly reserves the right to deny anyone access to the Services at any time for any reason with or without notice. You agree that Kunpo games may cease providing the Services or change the content of the Services at any time for any reason with or without notice to you without liability. YOU MUST BE THIRTEEN (13) YEARS OF AGE OR OLDER TO USE THE SERVICES. Additionally, if you are using or accessing the Services from a jurisdiction that requires a person to be older in order to participate legally in the Services, then you represent and undertake that you are of such legal age. Kunpo games reserves the right to request proof of age at any stage to verify that persons not of legal age are not using or accessing the Services. If you access the Services from a Social Networking Site (“SNS”), such as Facebook or Google+, then you acknowledge that you have also complied with, and will continue to remain in compliance with, the terms of service/use of such SNS as well as the Terms for the duration of your use of the Services.
For certain specific game users who may be subject to applicable laws and regulations, you hereby expressly agree that we will verify your personal information (including but not limited to your name, residential address, date of birth, ID card number, nationality, and passport number) in accordance with the laws and regulations of different release regions. We may also determine your geographical location through a location-based tracking function to confirm the legality of your use of or access to this Service.
We may require you to provide notarized copies of documents (i.e., documents must be stamped and certified by a notary public). If you fail to provide information and/or documents that satisfy us in accordance with our requirements, we shall have the right to terminate your account and your use of this Service, withhold any funds that may be present in your account, and shall not assume any liability whatsoever.
You represent that you are of legal age in the jurisdiction where you reside or from where you are accessing or using the Services, that you are of sound mind and capable of taking responsibility for your own actions. You represent that all details provided by you to Kunpo games at any time are true, current, correct, complete, and not misleading. You agree to use the Kunpo games site and Services in good faith for entertainment purposes and in complete accordance with these Terms, as each may be amended from time to time, and shall abide by all rules and instructions for playing the games and other entertainment that comprise the Services.
If you are prohibited from using or accessing this Service pursuant to the applicable laws and regulations of any release region, you shall not use this Service. You agree that your use of or access to this Service shall comply with all applicable laws, regulations and rules of the release regions, including but not limited to the export laws regarding software and data in Mainland China.
Your account will be terminated if we find that you have provided any incorrect or misleading information or documents.
You may be required to register a user account (“Account”) on the Services. If you create an Account, you agree that you will not create any Account for anyone else or create any Account in a false name or information. You shall maintain your Account information in strict confidence and shall not share your Account information with any third party. You are solely responsible for maintaining the confidentiality of your login information and for any and all activities (including purchases and charges, as applicable) that occur under your Account. You agree to immediately notify us of any suspected or actual unauthorized use of your Account or any other breach of security.
Kunpo games reserves the right to remove or reclaim any usernames at any time and for any reason, including but not limited to claims by a third party that a username violates the third party’s rights. You agree that you have no ownership or other property interest in the Account, and you further acknowledge and agree that all rights in and to the Account are and shall forever be owned by and inure to the benefit of Kunpo games.
Use of the Service is also governed by Kunpo games’ Privacy Policy, which is incorporated herein by reference. Your privacy is important to us. We designed Kunpo games’ Privacy Policy to make important disclosures about how we collect and use your content and information and how you can use the Service to share such information with others. We encourage you to read the Kunpo games Privacy Policy carefully and use it to make informed decisions.
By creating an Account or accessing or using the Service you accept and agree to be bound by these Terms and consent to the collection, use and storage of your information as outlined in Kunpo games’ Privacy Policy.
Subject to your agreement and continuing compliance with these Terms, Kunpo games grants you a personal, non-exclusive, non-transferable, non-sub licensable, revocable limited scope license to access and use the Service using a Kunpo games supported web browser or mobile device solely for your own non-commercial entertainment purposes. You agree not to use the Service for any other purpose.
These Terms do not grant you any right, title or interest in the Service or any content in the Service. You may not copy, modify, distribute, sell or lease any part of the Service or included content, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.
“User Content” means any communications, images, sounds, and all the material, data, and information that you upload or transmit through a Kunpo games game client or the Service, or that other users upload or transmit, including without limitation any chat text. By transmitting or submitting any User Content while using the Service, you affirm, represent and warrant that such transmission or submission is (a) accurate and not confidential; (b) not in violation of any laws, contractual restrictions or other third party rights, and that you have permission from any third party whose personal information or intellectual property is comprised in the User Content; (c) free of viruses, adware, spyware, worms or other malicious code; and (d) you acknowledge and agree that any of your personal information within such content will at all times be processed by Kunpo games in accordance with its Privacy Policy.
You agree that Kunpo games will not be liable for any User Content that is provided by others. We have no duty to pre-screen User Content, but we have the right to refuse to post, edit, delete or remove any User Content. We reserve the right to remove any User Content that is objectionable to us for any reason.
You understand that the Service is an evolving one. Kunpo games may require that you accept updates to the Service and to Kunpo games’ games you have installed on your device or computer. You acknowledge and agree that Kunpo games may update the Service and Kunpo games games, with or without notifying you. You may need to update third party software from time to time in order to receive the Service and play Kunpo games games.
WITHOUT LIMITING KUNPO GAMES’ LIABILITY UNDER SECTION 9 BELOW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. KUNPO GAMES DOES NOT WARRANT THAT YOU WILL BE ABLE TO ACCESS OR USE THE SERVICE AT THE TIMES OR LOCATIONS OF YOUR CHOOSING; THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE GAME OR THE SERVICE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
KUNPO GAMES SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR OTHER SIMILAR DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUES, LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION OR OTHER INTANGIBLE LOSSES (HOWEVER SUCH LOSSES ARE QUALIFIED), ARISING OUT OF OR RELATING IN ANY WAY TO THESE TERMS OR THE SERVICE ITSELF, WHETHER BASED ON CONTRACT, TORT OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT KUNPO GAMES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. KUNPO GAMES SHALL NOT BE LIABLE TO YOU FOR MORE THAN THE AMOUNT YOU HAVE PAID TO KUNPO GAMES IN ACCORDANCE WITH THESE TERMS IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT A CLAIM. YOU ACKNOWLEDGE AND AGREE THAT IF YOU HAVE NOT PAID ANYTHING TO KUNPO GAMES DURING SUCH TIME PERIOD, YOUR SOLE REMEDY (AND KUNPO GAMES’ EXCLUSIVE LIABILITY) FOR ANY DISPUTE WITH KUNPO GAMES IS TO STOP USING THE SERVICE AND TO CANCEL YOUR ACCOUNT.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above disclaimers and limitations may not apply to you. To the extent that Kunpo games may not, as a matter of applicable law, disclaim any warranty or limit its liability as set forth herein, the scope of such warranty and the extent of Kunpo games’ liability shall be the minimum permitted under such applicable law. IN PARTICULAR, NOTHING IN THESE TERMS SHALL AFFECT THE STATUTORY RIGHTS OF ANY CONSUMER OR EXCLUDE OR RESTRICT ANY LIABILITY FOR DEATH OR PERSONAL INJURY ARISING FROM ANY NEGLIGENCE OR FRAUD OF KUNPO GAMES.
You agree to indemnify, defend and hold Kunpo games harmless from any claim, demand, damages or other losses, including reasonable attorneys’ fees, asserted by any third-party resulting from or arising out of your use of the Service, or any breach by you of these Terms, however the foregoing does not apply if the infringement of rights is not attributable to your intentional or negligent behavior.
You and Kunpo games agree that any dispute, claim or controversy arising out of or relating in any way to these Terms or the Service shall be determined by binding arbitration or in small claims court. You agree that, by agreeing to these Terms, the U.S. Federal Arbitration Act governs the interpretation and enforcement of this provision, and that you and Kunpo games are each waiving the right to a trial by jury or to participate in a class action. This arbitration provision shall survive termination of these Terms and the termination of your Kunpo games account. The arbitration will be governed by the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (collectively, "AAA Rules") of the American Arbitration Association ("AAA"), as modified by these Terms, and will be administered by the AAA. The AAA Rules and Forms are available online at www.adr.org.
Kunpo games may assign or delegate these Terms and/or the Kunpo games Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any rights or obligations under the Terms or Privacy Policy without Kunpo games’ prior written consent, and any unauthorized assignment and delegation by you is void.
Kunpo games may publish additional policies related to specific services such as forums, contests or loyalty programs. Your right to use such services is subject to those specific policies and these Terms.
These Terms, any Supplemental Policies and any documents expressly incorporated by reference herein (including the Kunpo games Privacy Policy), contain the entire understanding of you and Kunpo games, and supersede all prior understandings of the parties hereto relating to the subject matter hereof, whether electronic, oral or written, or whether established by custom, practice, policy or precedent, between you and us with respect to the Service.
The failure of Kunpo games to require or enforce strict performance by you of any provision of these Terms or the Kunpo games Privacy Policy or failure to exercise any right under them shall not be construed as a waiver or relinquishment of Kunpo games’ right to assert or rely upon any such provision or right in that or any other instance.
The express waiver by Kunpo games of any provision, condition, or requirement of these Terms or the Kunpo games Privacy Policy shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement.
Except as expressly and specifically set forth in this these Terms, no representations, statements, consents, waivers, or other acts or omissions by Kunpo games shall be deemed a modification of these Terms nor legally binding, unless documented in physical writing, hand signed by You and a duly appointed officer of Kunpo games.
We may notify you via postings on www.kunpo.cc, and via e-mail or any other communications means to contact you. All notices given by you or required from you under these Terms or the Kunpo games Privacy Policy shall be in writing and addressed to: support@kunpo.cc. Any notices that you provide without compliance with this Section on Notices shall have no legal effect.
You acknowledge that the rights granted and obligations made under these Terms to Kunpo games are of a unique and irreplaceable nature, the loss of which shall irreparably harm Kunpo games and which cannot be replaced by monetary damages alone so that Kunpo games shall be entitled to injunctive or other equitable relief (without the obligations of posting any bond or surety or proof of damages) in the event of any breach or anticipatory breach by you.
You irrevocably waive all rights to seek injunctive or other equitable relief, or to enjoin or restrain the operation of the Service or any Kunpo games game, exploitation of any advertising or other materials issued in connection therewith, or exploitation of the Service or any content or other material used or displayed through the Service and agree to limit your claims to claims for monetary damages, limited by Section 9 (if any).
Kunpo games shall not be liable for any delay or failure to perform resulting from causes outside the reasonable control of Kunpo games, including without limitation any failure to perform hereunder due to unforeseen circumstances or cause beyond Kunpo games’ control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.
